1. Nature of Service
1.1. Orin Fintech (the “Company”, “We”, “Us”) operates a digital platform that provides customer profiling services to help users identify financial products (such as loans, credit cards, or insurance) suited to their needs.
1.2. We do not provide credit or financial products directly. We act as an intermediary “Matching Engine” that analyzes your responses to specific questions to suggest third-party financial service providers (“Partners”).
2. Applicability of the Terms
By continuing with the questionnaire, You hereby give Your unconditional consent to:
- These Terms.
- The “Privacy Policy” available on the Platform, which outlines our non-collection of personal data and is incorporated herein by reference.
- Any other notice, disclaimer, or policy posted on the Platform.
- The user represents and warrants the absolute integrity and authenticity of the data provided. While Orin Fintech facilitates the processing of such information, the legal title and responsibility for the sanctity of the data remain exclusively with the user.
These Terms may be amended at any time by the Company. All such amendments shall be binding on You upon being made available on the Platform. If You do not agree with any modification, Your sole remedy is to cease using the Platform. Your continued use of the Platform after changes are posted constitutes Your acceptance of the modified Terms. It is Your responsibility to review the most up-to-date version of the Terms periodically.
3. User Profiling & Session Access
- 3.1. No Registration Required: To protect Your privacy, Orin Fintech does not require You to create a traditional account linked to Your name, email, or phone number.
- 3.2. Anonymous Profiling: Use of the Platform is based on a session-specific “User Profile” generated through Your responses to financial questions. You are responsible for ensuring that the answers provided—such as income brackets, employment status, and credit requirements—are true, accurate, and complete to ensure the algorithm provides the most relevant product matching.
- 3.3. Inaccuracy of Data: If the Company has reason to believe the information provided by You is intentionally false or misleading, the Company reserves the right to terminate Your current session and restrict Your future access to the Platform.
- 3.4. Platform Security: Since the Platform does not use passwords or traditional logins, You are responsible for maintaining the privacy of Your own device and browser session to prevent unauthorized viewing of Your profiling results.
- 3.5. Non-Transferability: The right to use this Platform and the generated matching results is personal to You and is not transferable to any other person or entity.
4. No Collection of Personal Identifiable Information (PII)
4.1. Unlike traditional fintech platforms, Orin Fintech does not collect, store, or request personal sensitive data.
4.2. Our profiling is based strictly on non-identifiable inputs provided by you.
4.3. Any redirect to a Partner website for a formal application may require you to share PII with that Partner on their platform.
5. Customer Profiling & Product Matching
5.1. You agree to provide honest and accurate answers to the questions presented on the platform.
5.2. The “Right Product” recommendation is generated by an automated algorithm based solely on the data points you provide/select.
5.3. No Guarantee: While our goal is to ensure the “right product” match, Orin Fintech does not guarantee that you will be approved by the Partner or that the product suggested is the absolute best market rate available. The final decision to lend or provide service rests solely with the third-party Partner.
6. Eligibility
6.1. By using this platform, you represent that you are at least 18 years of age and a resident of India.
6.2. You agree that the use of this platform is for personal, non-commercial purposes to evaluate financial options.
7. Limitation of Liability
7.1. Orin Fintech shall not be liable for any credit decisions made by Partners.
7.2. Since we do not collect your personal data, we are not responsible for any identity theft or data breaches that occur on third-party Partner websites.
7.3. We do not charge customers any fee for the profiling service. Consequently, Orin Fintech is not liable for any financial loss or “missed opportunity” resulting from a recommendation.
8. Consents
8.1. In addition to any consent You may give pursuant to the Privacy Policy, You hereby consent to Lenders retrieving Your credit score from third party providers for the purpose of evaluating Your eligibility for a Credit Facility. For the avoidance of doubt, the Company itself does not retrieve Your credit score from any source.
9. Intellectual Property
9.1. All content, including the profiling algorithm, questionnaire logic, and the “Orin Fintech” brand, are the exclusive property of the Company. You may not scrape, copy, or reverse-engineer the platform.
9.2. The Company and its licensors, if any, shall be the sole and absolute owners of the Platform, including but not limited to the idea behind the Platform, the copyright in all content on the Platform and all trademarks, designs, logos and other insignia of trade used on the Platform and elsewhere during the performance of the services, all of which are subject to protection under patent, copyright, trade mark and trade secret and other intellectual property laws of India and other countries. We give You a limited, non-transferrable, non-sublicensable and revocable license to access the Platform, avail of the features of the Platform for Your personal, lawful requirements only. You are not entitled to duplicate, distribute, create derivative works of, display, or commercially exploit the Platform content, features or facilities, directly or indirectly, without Our prior written permission. Any copying of any part of the Platform shall entail immediate termination of these Terms without prejudice to the other rights and remedies of the Company, including for civil wrongs and criminal offences.
10. Third-Party Links
10.1. Our platform contains links to third-party websites. Once you leave the Orin Fintech platform, you are governed by the Terms and Privacy Policy of that specific third party. We encourage you to read their policies, especially as they will likely collect the personal information that Orin Fintech does not.
11. Indemnity
11.1. You hereby agree to defend, indemnify and hold harmless the Company, its affiliates, officers, directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees) arising from: (i) Your use of the Platform; (ii) Your violation of any term of these Terms; (iii) Your violation of any third party rights, including without limitation any copyright, property, or privacy right; and (iv) Your breach of the terms of Your contract with lenders. This indemnification obligation shall survive these Terms and use of the Platform.
12. Modifications to Terms
12.1. Orin Fintech reserves the right to modify these Terms at any time. Changes will be effective immediately upon posting on the website. Continued use of the platform constitutes your acceptance of the revised Terms.
13. Governing Law and Jurisdiction
13.1. These Terms are governed by the laws of India. Any disputes arising out of the use of this platform shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra.
